Subject ot the contract

The present General Conditions have for object the sale of the products carried out from Flavir Design of Moscone Daniela with center in Via Vincenzo Tomassini, 42 Rome P. IVA. 13515211004, REA number 1544549. Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Law no. 196/2003 and subsequent amendments.

Acceptance of the general conditions of sale

The contract between Flavir Design of Moscone Daniela and the customer must be understood as concluded with the acceptance of the order by Flavir Design at its headquarters. This acceptance is considered tacit. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to accept in full the general conditions and payment below.

If the Customer is a consumer (that is, a natural person who purchases the goods for purposes not related to his professional activity), once the purchase procedure has been completed, will print or save electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of art. 3 and 4 of Legislative Decree 185/1999 on distance sales and, as regards the protection of confidentiality, will be subject to the legislation referred to in Law n. 196/2003 and subsequent amendments.

Any right of the Customer to compensation or damages, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/ or property, caused by the non-acceptance, even partial, of an order.

Mode of purchase

PHYSICAL PRODUCTS:

The Customer can purchase the products contained in the catalog of Flavir Design at the time of the order as described in the relevant information sheets. It is understood that the image accompanying the descriptive card of a product may not be perfectly representative of its characteristics but differ in color, size, products accessories present in the picture. All purchase support information is intended as simple general information material. It is possible that, despite the constant updating of the site, some items are not actually available, in this case, the customer will be promptly contacted by e-mail for replacement or refund of the missing item.

The correct receipt of the order is confirmed by Flavir Design via e-mail, sent to the e-mail address communicated by the customer, if you do not receive the confirmation e-mail, If the customer does not find the e-mail in the inbox he is invited to check-in the spam folder of the e-mail. The message contains the summary of the order and all the data entered by the customer, who undertakes to verify its correctness and to promptly communicate any discrepancies, in the manner described in this document. It is the Customer’s responsibility to register with the correct data and keep such data up to date by means of access credentials.

All the amounts displayed in the Flavir Design shop are expressed in Euros and are without VAT pursuant to Article 1, paragraphs 54 to 89, of Law n. 190/2014 as amended by Law 208/2015 and Law n. 145/2018.

The delivery costs are indicated at the time of placing the order. The order fulfillment times are 7 working days. No liability can be attributed to Flavir Design in case there is a delay in the delivery of the material ordered, because of the Couriers.

At the time of delivery of the goods by the courier, the Customer is required to check

– that the number of packages delivered corresponds to that indicated in the transport document

– that the packaging is intact, undamaged, not wet or otherwise altered.

Any damage to the packaging and/or articles or the mismatch of the number of packages, must be immediately challenged by placing “control reserve” written on the proof of delivery of the courier and giving us immediately notification via e-mail to info@flavirdesign.com

Once the courier’s document has been signed, the Customer will not be able to dispute the external characteristics of what has been delivered.

In the event that the delivery does not go through due to causes not attributable to Flavir Design or the express courier, after 2 consecutive steps, you will be charged the costs of storage or return, as quantified by the express courier. In case of absence at the time of delivery, the courier will leave a notice of passage indicating a telephone number to allow you to agree on a redelivery. If even the second attempt fails, the package will go into storage and will be deposited in the nearest branch to the shipping address. To unlock the goods in stock you will be contacted by e-mail from Flavir Design. The goods will be delivered the day after the release of the stock.

In the event of failure to collect within 5 working days of the material in stock at the warehouses of the courier, due to repeated impossibility of delivery to the address indicated by the customer at the time of the order, the order will be automatically cancelled, therefore to have a new shipment, you need to make payment of shipping costs.

Right of Withdrawal

Pursuant to art. 5 DL 185/1999, if the customer is a consumer, that is a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to Flavir Design a reference VAT number, has the right to withdraw from the purchase contract for any reason, without having to provide any explanation and without any penalty, except as indicated in the following point.

Essential requirement for the application of the right of withdrawal is that the product is not used and is intact.

To exercise this right, the customer must send to Flavir Design a communication to this effect, within 10 working days from the date of receipt of the goods. Such communication shall be sent by registered letter with acknowledgement of receipt addressed to:

Once we have received the aforementioned notice of withdrawal, the Purchasing Office of Flavir Design, will promptly communicate to the customer instructions on how to return the goods that must be received by Flavir Design within 10 days of authorization.

The right of withdrawal is subject to the following conditions:

the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, software attachments, etc);

the purchased goods must be intact and returned in their original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc); to limit damage to the original packaging, we recommend, when possible, to insert it in a second box, bearing the RMA number (return authorisation code); in all cases, the affixing of labels or adhesive tapes directly on the original packaging of the product should be avoided;

in accordance with the law, the shipping costs related to the return of the goods are charged to the customer;

the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer;

in case of damage to the goods during transport, Flavir Design will inform the customer of the event (within 5 working days from receipt of the goods in their warehouses) in order to allow him to lodge a timely complaint with the courier of his choice and obtain a refund of the value of the property (if insured); in this case, the product will be made available to the customer for its return, simultaneously cancelling the withdrawal request;

Flavir Design is not liable in any way for damage or theft/loss of goods returned with uninsured shipments;

Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not arising from the transport. If the original packaging and/or packaging is damaged, Flavir Design will deduct from the refund due a percentage, however not more than 10% of the same, as a contribution to the costs of restoration.

Without prejudice to any restoration costs for damage to the original packaging, Flavir Design will refund the customer the amount already paid, in the shortest possible time and in any case within 30 days from the request for withdrawal, by bank transfer. The customer will promptly provide the bank details on which to obtain the refund (IBAN – Current Account of the invoice holder).

The right of withdrawal is totally forfeited, for lack of the essential condition of integrity of the good (packaging and/or its content), in cases in which Flavir Design establishes:

the absence of the outer packaging and/or the original inner packaging;

the absence of integral elements of the product;

damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, Flavir Design will return the purchased goods to the sender, charging the same shipping costs.

For payments with Paypal

For the cancellation of an order paid with Paypal we will treat a percentage of 4% of the total order.

DIGITAL PRODUCTS:

The files can be used for personal non-profit use, for commercial use customers must used them with a commercial license by contacting us at the e-mail address: info@flavirdesign.com. It is not possible to resell the printed product in any way. The digital files will not be shipped to customer’s physical address, once the payment has been finalized, you will receive an e-mail with the download of the purchased file.
